These terms govern your use of kestral.us and any web development or IT consulting services ("Services") provided by Kestral IT Consulting ("Kestral," "we," "us"). By using this site, booking a call, or engaging Kestral for Services, you agree to these terms.

Services

Kestral provides web development, network and systems setup, security implementation, and related IT support on a project or retainer basis. The specific scope, deliverables, timeline, and price for any engagement will be agreed separately (for example, by email or a written proposal) before work begins.

Scheduling

Calls booked through our scheduling calendar are subject to Calendly's own terms in addition to these. Please give at least 24 hours' notice to reschedule or cancel where possible.

Payment

Invoices are payable through our online payment portal, processed by Stripe. Payment is due upon receipt of an invoice unless other terms were agreed in writing. Fees already paid for work completed are generally non-refundable; refunds for undelivered work are handled on a case-by-case basis.

Client responsibilities

You agree to provide timely access, information, credentials, and feedback reasonably necessary for us to perform the Services, and to use any deliverables in compliance with applicable law.

Intellectual property

Unless otherwise agreed in writing for a specific project, final deliverables (code, designs, configurations) created specifically for you become your property once paid in full. We may retain and reuse general knowledge, tools, and non-client-specific components developed in the course of the work.

Acceptable use

You may not use this site or our Services to violate applicable law, infringe on others' rights, or attempt to disrupt, probe, or gain unauthorized access to our systems or those of our third-party providers.

Warranty disclaimer

Services are provided on an "as is" and "as available" basis. While we take reasonable care in our work, we make no warranty that any website, system, or deliverable will be completely uninterrupted, error-free, or secure against all possible threats.

Limitation of liability

To the extent permitted by law, Kestral's total liability for any claim arising from the Services is limited to the amount you paid for the specific engagement giving rise to the claim. We are not liable for indirect, incidental, or consequential damages.

Third-party services

Our site and Services rely on third-party providers, including Cloudflare, Resend, Calendly, Stripe, and Tawk.to. We are not responsible for the availability or performance of those third-party services.

Governing law

These terms are governed by the laws of the State of California, without regard to conflict-of-law principles, unless a separate written agreement between you and Kestral states otherwise.

Changes to these terms

We may update these terms from time to time. Continued use of the site or Services after changes are posted constitutes acceptance of the updated terms.
